eSIM ACCEPTABLE USE POLICY

This eSIM Acceptable Use Policy ("AUP") establishes the permitted and prohibited uses of eSIM, physical SIM, mobile data, roaming, Wi-Fi, and related telecommunications services ("Services") provided by SHORE ACCESS MARINE CORP. ("SHOREACCESS," "we," "us," or "our").

This Policy forms part of the SHOREACCESS Terms & Conditions and applies to all customers, users, resellers, affiliates, and other persons accessing or using our Services.

By purchasing, installing, activating, or using a SHOREACCESS eSIM or SIM card, you agree to comply with this Policy.

1. PURPOSE

​

SHOREACCESS provides international mobile connectivity services through telecommunications networks and technology partners.

The purpose of this Policy is to:

  • Protect the security and reliability of telecommunications networks;

  • Prevent fraud and abuse;

  • Protect customers and third-party network operators;

  • Ensure compliance with applicable laws and regulations;

  • Prevent misuse of SHOREACCESS Services; and

  • Maintain fair and reasonable access to mobile connectivity.

2. ACCEPTABLE USE

You may use SHOREACCESS Services for legitimate personal, business, travel, maritime, communication, and data-connectivity purposes.

Permitted activities may include:

  • Internet browsing;

  • Email;

  • Business communications;

  • Messaging;

  • Voice and video applications;

  • Social media;

  • Online meetings;

  • Navigation;

  • Travel applications;

  • Mobile applications;

  • Cloud services;

  • Remote work;

  • Accessing websites and online services; and

  • Other lawful Internet activities.

Use of the Service must comply with applicable laws, network requirements, and the terms of your purchased plan.

3. PROHIBITED ACTIVITIES

You must not use SHOREACCESS Services for unlawful, fraudulent, abusive, malicious, or harmful activities.

Prohibited activities include, but are not limited to:

3.1 Fraud and Deception

You must not use the Service to:

  • Commit fraud;

  • Conduct identity theft;

  • Impersonate another person or organization;

  • Conduct payment fraud;

  • Use stolen payment credentials;

  • Create fraudulent accounts;

  • Circumvent payment controls;

  • Facilitate scams; or

  • Obtain Services through false or misleading information.

4. ILLEGAL ACTIVITIES

You must not use SHOREACCESS Services to facilitate or participate in activities that violate applicable laws or regulations.

This includes activities prohibited by the laws of:

  • The country where you are located;

  • The country where the telecommunications service is provided;

  • The country of your residence; or

  • Other jurisdictions applicable to the relevant activity.

Customers are responsible for understanding and complying with local laws when using international telecommunications services.

 

5. NETWORK ABUSE

You must not use the Service in a manner that could damage, disrupt, overload, interfere with, or impair telecommunications networks.

Prohibited activities include:

  • Deliberately generating excessive network traffic;

  • Network flooding;

  • Denial-of-service activity;

  • Distributed denial-of-service activity;

  • Port scanning;

  • Network probing;

  • Unauthorized penetration testing;

  • Interference with network infrastructure;

  • Circumventing network controls;

  • Attempting to gain unauthorized access to network systems; or

  • Any activity that materially degrades network availability for other users.

 

6. CYBERSECURITY AND MALICIOUS ACTIVITY

You must not use SHOREACCESS Services to distribute, transmit, host, or facilitate:

  • Malware;

  • Viruses;

  • Trojans;

  • Ransomware;

  • Spyware;

  • Botnets;

  • Malicious scripts;

  • Credential-stealing tools;

  • Phishing campaigns;

  • Exploit code used for unauthorized attacks; or

  • Other malicious software or content.

You must not use the Service to gain unauthorized access to computers, servers, accounts, networks, databases, or other systems.

 

7. SPAM AND UNAUTHORIZED COMMUNICATIONS

You must not use SHOREACCESS Services for unlawful or abusive bulk communications.

Prohibited activities may include:

  • Spam;

  • Unsolicited bulk messaging;

  • Automated messaging without appropriate authorization;

  • SMS abuse;

  • Phishing messages;

  • Fraudulent communications;

  • Robocalling where prohibited;

  • Harassment campaigns; or

  • Communications designed to evade spam or security controls.

 

8. AUTOMATED OR HIGH-VOLUME TRAFFIC

SHOREACCESS Services are generally intended for normal mobile connectivity.

Unless expressly authorized under a specific business or enterprise plan, you must not use an eSIM primarily as a substitute for:

  • Dedicated Internet connectivity;

  • Permanent fixed-line Internet;

  • Commercial telecommunications infrastructure;

  • Public Wi-Fi services;

  • Large-scale automated data transfer;

  • Network access resale; or

  • Other services for which the purchased plan was not designed.

Examples of potentially restricted usage include sustained automated traffic, large-scale scraping, continuous server traffic, or unusually high-volume machine-to-machine communications.

 

9. SERVERS, HOSTING, AND NETWORK SERVICES

Unless expressly permitted by the applicable plan or written agreement, customers must not use a SHOREACCESS mobile data connection to operate or provide:

  • Public servers;

  • Proxy services;

  • VPN resale services;

  • Commercial hosting;

  • Public Wi-Fi hotspots;

  • Network gateways;

  • Traffic-relay services; or

  • Other services that provide connectivity to third parties.

 

SHOREACCESS may permit certain business or enterprise applications under separately agreed commercial terms.

 

10. TETHERING AND HOTSPOT

Tethering and mobile hotspot functionality may be permitted depending on the purchased plan.

Customers must comply with any hotspot, tethering, device, speed, data, or Fair Usage limitations applicable to their plan.

Where a specific plan prohibits tethering or hotspot usage, customers must not circumvent such restrictions.

 

11. VPN USAGE

Use of VPN services may be permitted for legitimate purposes, including:

  • Secure remote work;

  • Business communications;

  • Privacy protection; and

  • Access to authorized corporate systems.

However, a VPN must not be used to:

  • Circumvent SHOREACCESS security controls;

  • Evade applicable usage restrictions;

  • Conceal fraudulent activity;

  • Conduct unauthorized network access; or

  • Violate applicable law.

SHOREACCESS does not guarantee that every VPN service will function on every network or eSIM plan.

 

12. LOCATION AND REGIONAL RESTRICTIONS

Customers must use an eSIM only in countries and territories supported by the purchased plan.

A plan described as covering a particular country or region does not necessarily provide coverage in every geographic area within that country or region.

Customers must not attempt to circumvent geographic, regulatory, roaming, or network restrictions.

 

13. DEVICE AND SIM SECURITY

Customers must take reasonable measures to protect their eSIM, SIM card, activation information, QR code, redemption code, and account credentials.

You must not:

  • Share activation credentials with unauthorized persons;

  • Attempt to duplicate an eSIM;

  • Clone a SIM;

  • Reverse engineer an eSIM profile;

  • Extract protected SIM credentials;

  • Circumvent SIM security mechanisms; or

  • Attempt to transfer an eSIM in a manner not supported by SHOREACCESS or the relevant telecommunications provider.

 

14. eSIM PROFILE COPYING OR DUPLICATION

An eSIM profile, QR code, activation code, or redemption code is intended for authorized use by the purchaser or designated user.

You must not attempt to:

  • Copy;

  • Clone;

  • Duplicate;

  • Resell;

  • Extract;

  • Modify;

  • Reverse engineer; or

  • Redistribute

an eSIM profile or its authentication credentials without authorization.

 

15. UNAUTHORIZED RESELLING

Customers may not resell, redistribute, transfer, or commercially exploit SHOREACCESS Services unless they are enrolled in an authorized SHOREACCESS reseller, affiliate, distributor, or wholesale program.

Authorized resellers must comply with their applicable commercial agreement and SHOREACCESS brand guidelines.

 

16. MULTIPLE DEVICES AND ACCOUNT SHARING

Unless expressly permitted by the purchased plan, customers must not share a single eSIM, account, authentication credential, or Service among multiple unauthorized users or devices.

Some eSIM products may be technically restricted to a single device after installation.

Customers must follow the product-specific terms provided at purchase.

 

17. COMMERCIAL AND MACHINE-TO-MACHINE USE

Some SHOREACCESS Services may be suitable for business, maritime, IoT, machine-to-machine, or enterprise applications.

Where such use involves:

  • Automated devices;

  • Fleet connectivity;

  • Maritime equipment;

  • Industrial equipment;

  • IoT devices;

  • Remote monitoring;

  • Large-scale data consumption; or

  • Multiple connected devices,

SHOREACCESS may require a separate commercial or enterprise agreement.

Customers must not use a consumer plan for large-scale commercial deployment where doing so violates the applicable plan conditions.

 

18. DATA USAGE AND FAIR USAGE

Some SHOREACCESS plans may include Fair Usage Policies ("FUP"), data thresholds, speed limitations, hotspot restrictions, or other network-management provisions.

Customers acknowledge that:

  • Data speeds may vary;

  • High-speed data may be subject to a specified allowance;

  • Speeds may be reduced after a threshold is reached;

  • Network operators may apply reasonable network-management measures; and

  • Some activities may consume substantially more data than ordinary browsing.

Exceeding a stated high-speed allowance does not necessarily constitute a Service failure.

 

19. NETWORK MANAGEMENT

SHOREACCESS and its telecommunications partners may implement reasonable network-management measures to:

  • Protect network stability;

  • Prevent abuse;

  • Manage congestion;

  • Protect users;

  • Comply with telecommunications requirements; and

  • Maintain network quality.

Such measures may include temporary speed restrictions, traffic management, suspension, or other reasonable controls where permitted by the applicable Service terms.

 

20. LOCAL TELECOMMUNICATIONS REGULATIONS

International telecommunications services are subject to the laws and regulations of the countries in which the Services are used.

Certain countries may impose requirements concerning:

  • SIM registration;

  • Subscriber identification;

  • Telecommunications licensing;

  • Data usage;

  • Roaming;

  • Device registration;

  • Network access;

  • Content restrictions; or

  • Other telecommunications activities.

Customers are responsible for complying with applicable local requirements.

SHOREACCESS may be required to suspend or restrict a Service to comply with local laws, telecommunications-provider requirements, or regulatory instructions.

 

21. CONTENT AND COMMUNICATIONS

SHOREACCESS generally does not control the content transmitted through third-party Internet services.

Customers are solely responsible for the content and communications they transmit using the Services.

You must not use SHOREACCESS connectivity to transmit content that is unlawful or violates the rights of others.

2. COPYRIGHT AND INTELLECTUAL PROPERTY

You must not use SHOREACCESS Services to unlawfully:

  • Download;

  • Upload;

  • Distribute;

  • Reproduce; or

  • Share

copyrighted or other protected material.

You are responsible for obtaining any permissions required for content you access or transmit.

 

23. HARASSMENT AND ABUSE

You must not use SHOREACCESS Services to threaten, harass, stalk, intimidate, defame, or abuse other individuals.

We may investigate credible reports of abusive or unlawful use and may take appropriate action where permitted by law.

 

24. CHILD SAFETY

You must not use SHOREACCESS Services to facilitate the exploitation, abuse, or endangerment of children.

Any use involving illegal child exploitation material or activities will be treated as a serious violation and may be reported to appropriate authorities where required or permitted by law.

 

25. FRAUD MONITORING

SHOREACCESS and its payment, telecommunications, and technology partners may use reasonable security and fraud-detection measures.

These measures may include monitoring:

  • Transaction patterns;

  • Account activity;

  • Device information;

  • Network activity;

  • Usage patterns;

  • Activation activity; and

  • Other information reasonably necessary to detect fraud or abuse.

Such processing will be conducted in accordance with applicable law and our Privacy Policy.

 

26. SUSPENSION OR TERMINATION

SHOREACCESS may suspend, restrict, or terminate Services where we reasonably believe that:

  • The Service is being used in violation of this Policy;

  • Fraud has occurred or is suspected;

  • The account or payment method is unauthorized;

  • The Service is being used for illegal activity;

  • Network abuse has occurred;

  • Security risks exist;

  • The telecommunications provider requires suspension;

  • Local law requires restriction; or

  • Continued Service could materially harm SHOREACCESS, its customers, or network partners.

Where appropriate and legally permitted, SHOREACCESS may provide notice before suspension.

 

27. NO REFUND FOR PROHIBITED USE

Where permitted by applicable law, customers whose Services are suspended or terminated because of fraud, abuse, unlawful activity, or material violation of this Policy may not be entitled to a refund.

This provision does not limit any mandatory consumer rights.

 

28. INVESTIGATION

SHOREACCESS may investigate suspected violations of this Policy.

Customers agree to reasonably cooperate with legitimate investigations concerning suspected:

  • Fraud;

  • Security incidents;

  • Unauthorized access;

  • Network abuse;

  • Payment fraud;

  • eSIM misuse; or

  • Other violations of these Terms.

SHOREACCESS may preserve and disclose information when reasonably necessary to comply with applicable law, protect rights, investigate security incidents, or respond to lawful requests from authorities.

 

29. THIRD-PARTY NETWORK REQUIREMENTS

Because SHOREACCESS Services may rely upon third-party telecommunications networks and roaming partners, customers must also comply with applicable network-provider requirements.

A third-party telecommunications provider may independently restrict, suspend, or terminate connectivity in accordance with its own policies and applicable law.

 

30. REPORTING ABUSE

If you believe that a SHOREACCESS Service is being used for fraud, network abuse, unauthorized activity, or other prohibited conduct, please contact us.

31. PRIVACY

Information collected in connection with security, fraud prevention, account management, network operation, and Service provision will be processed in accordance with our Privacy Policy and applicable data-protection laws.

 

32. CHANGES TO THIS POLICY

SHOREACCESS may modify this Acceptable Use Policy from time to time to reflect changes in:

  • Telecommunications services;

  • Network requirements;

  • Technology;

  • Security threats;

  • Business practices; or

  • Applicable laws and regulations.

The "Last Updated" date indicates the most recent revision.

 

33. GOVERNING TERMS

This Policy forms part of the SHOREACCESS Terms & Conditions.

If there is a conflict between this Policy and a specific written commercial agreement, the applicable written agreement will govern to the extent of the conflict.

35. ACCEPTANCE

By purchasing, installing, activating, or using a SHOREACCESS eSIM, SIM card, mobile data plan, or other connectivity Service, you acknowledge that you have read, understood, and agree to comply with this Acceptable Use Policy.
